Most insurance companies handle uninsured and underinsured cases the same way they handle third-party cases in disregard of their obligation of good faith and fair dealing. This discussion will cover how the insurance companies are not fulfilling their duty in these cases by treating their insureds in an adversarial manner, how to lay out the minimum standards to which they must comply, and when to consider proceeding with a bad faith action after conclusion of the first party case.
