Designed to improve quality of life for individuals with special needs without disqualifying them for means-tested benefits, special needs trusts are difficult to create properly and still more difficult to administer. First, we will outline the purpose and types of special needs trusts and overview the arcane rules governing their administration. Next, we will address the circumstances and devices for creating and modifying special needs trusts through litigation, and discuss select case law involving special needs trusts.
